RAPID CITY, S.D.—A Denver police officer accused of shooting at Custer County sheriff’s deputies and a Highway Patrol trooper will not be charged with attempted murder but still faces three aggravated assault charges.

Thirty-one-year-old Kachina McAlexander of Aurora, Colo., was arrested March 24 and accused of shooting at the law officers, who were checking on her at a motel near Custer. No one was injured.

A judge in Custer ruled Tuesday that the officers’ testimony wasn’t enough to prove attempted murder, calling it one of the weakest attempted murder cases he’s ever seen.

Sheriff Rick Wheeler says he is disappointed because the officers’ lives were in danger.

The defense lawyer said the facts show there wasn’t enough evidence to prove attempted murder.
