FORT COLLINS, Colo.—After more than a year in jail, a suspect in the 1998 slaying of a transient man has been released and a first-degree murder charge has been dropped.
The Larimer County District Attorney’s Office on Thursday filed a motion to dismiss charges filed against 57-year-old Frank Webb of Muscatine, Iowa. He faced charges in the Sept. 14, 1998, slaying of Gary Birk.
In a statement, the DA’s office charges were dropped against Webb in the interest of justice because of the current state of evidence. Webb was arrested in April 2008 and faced mandatory life in prison if convicted.
Another man, 46-year-old David Griffin, faces several charges in Birks’ death, including first-degree murder. Griffin will stand trial Sept. 21.
