Secretary of State Bernie Buescher on Wednesday halted rule-making on an under-siege constitutional amendment that would ban sole-source contract holders, the executives who oversee companies with sole-source contracts and their extended families from giving to political campaigns.
A district judge last month suspended Amendment 54, which applied to contracts of $100,000 or greater. And while the appeal is pending, Buescher said there’s no point in clarifying a law that might not survive.
“The judge’s ruling eliminated the campaign finance provisions and ultimately the jurisdiction of my office,” Buescher said. “If a final ruling restores jurisdiction, we will make rules as appropriate in order to implement Amendment 54.”
The portion of the amendment requiring the state to keep a public list of sole-source contracts remains intact.
