GRAND JUNCTION, Colo.—Criminal charges are being dropped against a Grand Junction nurse accused of assaulting a woman with multiple sclerosis.

Mesa County prosecutors are moving to dismiss assault and charges against 23-year-old Errin Hubbard.

Hubbard was an aide at a Grand Junction nursing home. She was charged last year after another nurse’s aide allegedly saw Hubbard put a pillow over the face of the 53-year-old patient.

The case was dropped after the patient said she could not testify for health reasons. Authorities said that without the patient’s testimony, they couldn’t expect a prosecution.

Hubbard denied wrongdoing.
