STEAMBOAT SPRINGS, Colo.—A man on trial for a fight that left a Fort Bragg, N.C. soldier dead after a bar dispute held back tears as he testified that he was scared in the moments before the altercation.

David Capote took the stand Friday in Steamboat Springs, where he is facing a third-degree assault charge for the fight that killed Sgt. 1st Class Richard Lopez. Capote’s brother, Eduardo Capote, is accused of punching Lopez. Police say the 37-year-old solider died after falling and hitting his head on the pavement.

Authorities say the Capotes and their friends had argued with Lopez and his friends over songs being played on the jukebox.

David Capote testified that he became scared when he saw Lopez and his friends outside the bar and knew they were going to fight.
