RAPID CITY, S.D.—The attorney for a man charged in the 1975 killing in South Dakota of a fellow American Indian Movement activist says next week’s trial should be postponed.

Richard Marshall of Rapid City has pleaded not guilty in federal court to murder and aiding and abetting in the death of Annie Mae Aquash (AH’-kwash). Authorities say she died from a gunshot wound to the back of the head.

Defense attorney Dana Hanna says in court documents filed Thursday that he needs a continuance so he can review information recently provided by the government. It involves evidence from the Denver Police Department.

Authorities say three AIM members drove Aquash from Denver to Rapid City, where she was held against her will and questioned about whether she was an FBI informant before being killed.

Trial is scheduled to begin Tuesday in Rapid City.
