BOULDER, Colo.—Boulder city officials are considering paying $230,000 to settle a lawsuit filed by a man who was hit in the eye by a police pepper ball during a 2004 disturbance.

The City Council will vote next week on the proposed settlement with Jonathan Lemery, who was a 22-year-old University of Colorado student at the time.

Police were trying to disperse a crowd of about 1,500 that gathered after officers broke up a street party on Halloween.

Lemery says he was approaching police to ask for help in removing some people who had taken refuge in his house when an officer fired a pepper ball at him. The lawsuit says Lemery lost depth perception and peripheral vision in his right eye and suffers from double vision.

He now lives in San Diego.
