BOULDER, Colo.—Authorities won’t prosecute a man who addressed the Boulder City Council while wearing only boxer shorts and who was arrested after police alleged he refused to leave the podium.
The Boulder City Attorney’s office said Friday the officer had probable cause to arrest 43-year-old Seth Brigham. But officials say there was also confusion during the meeting two weeks ago about what is the proper procedure for asking someone to leave.
In this case, a council member other than the mayor asked to have Brigham removed and officials say that’s not the correct procedure.
Brigham says he was making a point about the city’s recent proposal to criminalize nudity but he was asked to leave when he began talking about council members. One of them later expressed concern that Brigham’s free-speech rights were violated.
