DENVER—Former Qwest CEO Joe Nacchio is expected in federal court in Denver Tuesday to say whether he wants to waive his right to attend re-sentencing hearings.
U.S. District Judge Marcia Krieger wants to see Nacchio before allowing him to skip hearings at which she will recalculate a six-year sentence, plus $71 million in fines and forfeitures, which an appeals court ruled were too harsh.
Hearings on a new sentence are scheduled for June 22-24.
Nacchio is in prison in Pennsylvania on insider trading convictions. The Denver Post reported Friday that Nacchio had been moved to a federal transfer center in Oklahoma City.
No one at the U.S. Marshal’s office in Denver was available for comment after business hours Friday.
