The Colorado Supreme Court has declined to hear the case of a Longmont medical-marijuana grower whose conviction for drug distribution was upheld by the state appeals court in a landmark ruling.

The appeals court ruled late last year that Stacy Clendenin’s conviction was valid because, under the court’s interpretation of Colorado’s constitutional provision for medical marijuana, caregivers must do more than just provide pot to patients. Clendenin had argued her marijuana-growing was legal because all her product was distributed through dispensaries, even though she had little contact with the patients her marijuana went to.

The appeals court’s ruling sent dispensaries and caregivers in the state scrambling to offer other services to patients — such as massage or counseling — to qualify for legal protection.
