GLENWOOD SPRINGS, Colo.—A Rifle man who shot and killed his brother has accepted a plea deal that brings a likely sentence of 48 years in prison.
Twenty-one-year-old Heath Johnston admitted shooting his older brother Sam Johnston in the back of the head in 2008. The victim was sitting on a couch at his home in Rifle when he was killed.
Heath Johnston told police that his brother had been unhappy and had asked to be shot. The (Glenwood Springs) Post Independent reports that Heath Johnston earlier pleaded not guilty by reason of insanity.
Heath Johnston pleaded guilty Thursday to second-degree murder and will be formally sentenced Oct. 6.
