The lawyer for a Texas boy accused of kicking a rock off a Colorado cliff and killing a Michigan girl says the boy intends to plead not guilty.
Attorney Larry Mertes told The Grand Rapids Press that 16-year-old Freddie Henderson Bailey III would enter the plea in a hearing set for Friday.
Bailey, of Katy, Texas, is charged with manslaughter. Authorities allege that a rock he kicked fell about 30 feet from a cliff and struck 17-year-old Audra Brownell in Estes Park this summer.
Mertes says he intends to seek a trial and challenge that there was any crime committed.
In Colorado, a manslaughter conviction requires a finding of recklessness.
