An employee of one of three Loveland medical marijuana dispensaries that have sued to block a city ordinance that shut them down Tuesday has been cited for selling pot that day.
Code enforcement and police officers visited 14 known dispensaries in Loveland on Tuesday to make sure they had closed as required by a city ordinance passed in November.
One, Colorado Canna Care, at 129 S. Cleveland Ave., was open for business.
Loveland police say Crystal McDaniel an employee of Colorado Canna, was issued a municipal summons for violating the ordinance the prohibits the cultivation and sale of medical marijuana in the city. Police say a criminal investigation is underway.
Attorney Robert Corry Jr., filed a complaint in Larimer District Court late Monday, seeking a temporary restraining order that would allow the dispensaries to remain open. Corry claimed the city’s ban on dispensaries “is unconstitutional, because it unduly burdens patients and caregivers.”
His clients in the suit include dispensaries Colorado Canna, Magic’s Emporium at 2432 E. 13th St., and Rocky Mountain Kind, at 1710 W. Eisenhower Blvd., and two unnamed patients.
