Two men accused of smuggling rhinoceros horns have lost their bid to get the case thrown out and have filed motions indicating they plan to plead guilty.
Irish citizens Richard O’Brien and Michael Hegarty are charged in federal court in Denver with trying to smuggle four horns out of the country. They had contested the charges, arguing that their due-process rights were violated and that they hadn’t taken steps to smuggle anything.
But in an order last week, Chief U.S. District Judge Wiley Daniel rejected those arguments. Attorneys for O’Brien and Hegarty filed a “notice of disposition” this week, a step normally taken when a defendant has reached a plea deal.
