A federal grand jury in Denver has indicted an alleged illegal immigrant from Ireland on a felony charge of possessing 50 rounds of Winchester 40-caliber ammunition.

“It is against federal law for someone in the United States illegally to possess ammunition,” the U.S. Attorney’s Office in Denver said today.

Kevin Barry McAuley, 46, of Belfast, was arrested in Denver on Aug. 17. He was previously deported from the United States in February 2006, prosecutors said.

McAuley also uses the names Michael Gabriel Hoverty, Keith Christopher Morony, Kevin Loughrin, Steven Maloney and Patrick Roche, they said.

If convicted on the charge of being an alien in possession of ammunition, McAuley could be sentenced to up to 10 years in federal prison and up to a $250,000 fine.

If convicted of the original charge of illegal reentry, he faces up to two years in prison and a fine of up to $250,000.

“Anyone who unlawfully re-enters the United States after having been formally deported commits a felony,” John Longshore, field office director for the U.S. Immigration Customs Enforcement’s enforcement and removal operations unit in Denver, said in a media release.

“ICE … works closely with the U.S. Attorney’s Office to aggressively prosecute these reentry cases.”
