A Fort Collins woman who fatally stabbed an ex-boyfriend in the neck with a broken beer bottle will not face criminal charges.

Prosecutors have determined that the woman had been physically assaulted and was defending herself when the incident happened, according to a Larimer County District Attorney’s Office media release.

Shaun Cassidy, 23, of Montrose, died Oct. 9 from injuries suffered a week earlier.

The incident happened in the woman’s Fort Collins home and Colorado’s “Make My Day” laws apply in the case, prosecutors said.

“Evidence shows that Shaun Cassidy was forcing his way back into the apartment after having been physically removed following his assault” of the woman, the DA’s office said. The facts of the case provide “immunity against criminal prosecution.”
