Loveland city councilors will take on a federal case Tuesday night, going behind closed doors for advice on how to deal with an 8-year-old lawsuit pitting the city against two real estate developers.

The private discussion among councilors and lawyers stems from a mid-November federal appeals court ruling, setting aside parts of a U.S. District Court decision regarding a lawsuit filed by brothers Steve and Ed Klen, developers of the east-Loveland Anasazi Business Park.

The Klens’ Boulder lawyer, John Pineau, sent a letter shortly after the ruling by the 10th Circuit Court of Appeals inviting the city to consider a pretrial settlement.

“I wish them the best of luck,” Pineau said Monday of the pending legal discussion. “Although the trial is imminent, we have a duty to our client to try to resolve this, and we’re open to that.”
