DENVER—Denver Clerk and Recorder Debra Johnson has filed a complaint seeking to overturn a rule on mailing ballots in nonpartisan and coordinated municipal elections.

Johnson contends the rule enacted by Colorado Secretary of State Scott Gessler infringes on Denver’s status as a home-rule city and county.

Gessler and Johnson already were tangling over Johnson trying to send ballots to inactive voters in the November 2011 election, when voters were deciding a statewide ballot question.

In August, Gessler adopted a rule saying ballots also couldn’t be mailed to inactive voters in local elections such as those for City Council.

Johnson’s challenge of that rule won’t affect the mailing of ballots for the Nov. 6 election.

Gessler described the lawsuit to The Denver Post () as “grandstanding.”
