LONGMONT, Colo.—Two Longmont police officers who aren’t union members have filed a lawsuit seeking refunds of union fees the city collected from their paychecks.

Officer Cary Nickolls and Sgt. Jim Bundy filed the suit Tuesday in federal court against the Colorado Fraternal Order of Police, its Longmont chapter and the city of Longmont.

A union official told the Daily Times-Call ( ) that commissioned officer union members pay $600 in dues annually, while non-members pay a fluctuating “fair share” fee to cover costs of collective bargaining.

The U.S. Supreme Court has said union officials can collect union fees as a condition of employment, but the officers say union officials didn’t first provide them an audited breakdown of the fee to ensure their money wouldn’t be spent on items besides collective bargaining.
