United Western Bancorp filed an appeal Tuesday seeking to that upheld the seizure of the company’s bank by the Office of Thrift Supervision.
The Denver-based bank holding company sued federal regulators in February 2011 over what it argued was their improper seizure of its chief asset, United Western Bank, a month earlier.
United Western, which was raising capital to preserve the $2 billion thrift, argued the seizure was premature. Observers described the effort as a David vs. Goliath battle and U.S. District Court Judge Amy Berman Jackson ruled in March that regulators were not unreasonable given the circumstances at the time.
