A charge of sexual assault on a child by a person in a position of trust against Matthew Melendez was dropped Dec. 23, Denver District Attorney’s spokeswoman Lynn Kimbrough said.
The DA’s office decided it “could not prove the charge beyond a reasonable doubt,” Kimbrough said. “We did not have enough evidence to go forward.”
Melendez, a paraprofessional at Valdez Elementary School, 2525 West 29th Ave., remains on a standard practice leave as DPS conducts a review of the case, according to a school letter to parents dated Monday.
Melendez, who worked with students in a highly staffed program for students with disabilities, has been on unpaid leave since August. The month before, a parent reported that her fifth-grade son had been touched inappropriately. The same parent made a and the DA declined to file charges in that case.
