The Denver District Attorney formally charged an 86-year-old man Wednesday in a fatal hit-and-run that happened early last month.
Marshall Smith resulting in death, a felony, according to a news release from the Denver District Attorney’s Office.
The charge stems from a Jan. 9 incident in which Smith allegedly turned right eastbound Exposition Avenue onto southbound Colorado Boulevard and allegedly hit 63-year-old Leanna Hund, who was crossing with the signal.
Smith has been released on bond.
He is scheduled to appear in Denver court on Mondayto be formally advised of the charge.
