VAIL — A judge has ruled there is enough evidence for the case to move forward against a former Eagle County sheriff’s deputy accused of sexually assaulting a woman in a vacant warehouse.
District Judge Paul Dunkelman ruled after a preliminary hearing that 42-year-old Timothy Joseph Hay will stand trial.
The woman told investigators she was driving Hay home after drinking at a bar Sept. 18 when Hay asked her to pull over at a warehouse near the Eagle County airport. Hay is accused of slamming the woman’s face into a wall and sexually assaulting her.
Hay moved to Eagle County in 1995 and joined the department in 2003. He was off duty at the time of the alleged assault.
