Federal regulators have the authority to decide whether the city of Boulder can take over a high-voltage transmission line as part of its condemnation of Xcel Energy’s Boulder distribution system, according to a Federal Energy Regulatory Commission ruling issued Thursday.
Xcel asked FERC to intervene in Boulder’s condemnation case as part of a broader strategy of challenging the city’s push toward municipalization.
Xcel already had obtained a ruling from the Colorado Public Utilities Commission that stated Boulder should seek approval from state regulators before filing for condemnation of assets outside city limits.
In addition to acquiring Xcel’s local distribution system, Boulder is seeking all or part of several substations that serve city and Boulder County customers, the distribution infrastructure associated with those substations and a high-voltage transmission loop that circles the city.
