An RTD driver who ran over and killed a 62-year-old man at the Boulder Transit Center in November won’t face charges after police and prosecutors determined there was no evidence he was aware he’d struck the victim.

Boulder County District Attorney Stan Garnett said Thursday that the victim may have been in the path of the bus, and the driver — who has not been identified — may not have been aware that he had run someone over before driving away from the scene.

“This was obviously a very tragic situation, and it is very sad for everyone involved, especially the victim’s family,” Garnett said. “However, we did not have evidence from which we could establish that, first of all, the driver of the bus violated a traffic law in the accident.

“Second, there was no evidence to establish he knew he had hit the victim and left the scene as it occurred.”
