BRIGHTON — Two men accused of a will stand trial, a judge ruled Friday after the preliminary hearing ended.

Gabriel Lee Flores, 41, and Furmen Lee Leyba, 30, were arrested a day after they allegedly shot three men in a home on Cragmore Street, just north of Denver, on Dec. 10.

The preliminary hearing began April 24, when Jefferson County Deputy John Spaw, Adams County Deputy Heath Gumm and Adams County Sgt. Michael Robbins testified. Adams County Detective James Morgen began his testimony, but the judge issued a continuance after Flores told his attorney he was ill and could not return to the courtroom. The hearing resumed Friday, when Morgen provided additional testimony about witness interviews, the suspects’ arrests and the crime scene on Cragmore Street.

After testimony concluded, Adams County District Judge Thomas Ensor found probable cause to send the case to trial. Arraignment is scheduled for June 5.

Flores will face three counts of first-degree murder after deliberation, three counts of felony murder, one count of attempted first-degree murder, four counts of aggravated robbery and one count each of vehicular eluding and possession of a controlled substance.

He is being held without bond.

Leyba will be tried for three counts of felony murder and three counts of aggravated robbery. Ensor set bond for Leyba at $500,000.

Johnny Angel Gutierrez, 18, Jason Albert Quizada, 37, and Jayson Antonio Figueroa, 17, were killed during the shooting.

Morgen said there was significant evidence of drug use and drug distribution throughout the house, and police recovered large amounts of methamphetamine and cash when they searched the premises.

A witness reported hearing, “Where’s the money?” before the shots began.
