
A man arrested early Monday morning at the scene of an attack on an Aurora police officer has been identified and the charges against him have been dismissed.
Garnett Lee Hubbard, 24, originally was arrested on suspicion of disorderly conduct and failure to obey an order, according to an Aurora Police Department media release.
Hubbard’s arrest was in relation to an and subsequent officer-involved fatal shooting.
An Aurora officer was making a good Samaritan check on a stopped vehicle near Interstate 225 and East Alameda Avenue early Monday when he was attacked, suffering a head wound, police said. The suspect stole the patrol car and led a chase at speeds of up to 65 mph on icy roads.
Hubbard, a passenger in the stopped vehicle, remained at the scene of the original assault.
Near East Alameda Parkway and East Kentucky Avenue, one of the pursuing officers bumped his vehicle into the stolen patrol car, spinning it to a stop. The suspect got out of the patrol car holding something in his right hand, police say. Officers ordered him to drop the object and raise his hands and, when he did not comply, they opened fire. The suspect was pronounced dead at the scene.
The man’s name has not yet been released.
The charge against Hubbard has been dismissed, police said, “to conduct additional investigation into the full extent of Hubbard’s involvement.”
The dismissal doesn’t prevent charges from being filed in the future, if appropriate, police said.
