GRAND JUNCTION, Colo. (AP) — Attorneys for a 17-year-old charged with killing a western Colorado sheriff’s deputy say they might try to move his case back to juvenile court.
The Grand Junction Daily Sentinel reports (http://tinyurl.com/grr3sjt) Austin Holzer appeared in court Tuesday on charges of first-degree murder and other counts.
He was originally charged as a juvenile in the Feb. 8 shooting death of Mesa County Deputy Derek Geer, but prosecutors said last week they would charge him as an adult.
Geer was trying to arrest Holzer on charges of violating probation in a sex-assault case.
According to an arrest warrant affidavit, Holzer told police he tried to shoot himself as he and Geer struggled, but the gun didn’t fire. The affidavit quotes Holzer as saying he then pointed the gun at Geer and fired.
