Brother of Lincoln County sheriff gets 90 days in jail for gun theft case

The brother of Lincoln County Sheriff Tom Nestor has been sentenced to 90 days in jail following accusations that he last year.

Court records show the sentence for Dustin Zane Nestor was handed down on Friday and also included a penalty of five years of supervised probation. He pleaded guilty in May to embezzlement of public property, a Class 5 felony, according to the records.

Other allegations in the case were dismissed by prosecutors.

Dustin Nestor, 34, was an employee of the sheriff’s office when he admitted to investigators that he stole the weapons, according to an arrest warrant. Authorities say Nestor gave both of the guns .

“You violated the trust of the sheriff’s office,” a judge told Nestor at Friday’s sentencing, according to video of the hearing .

The television station captured Nestor being led from a courtroom in handcuffs.

Nestor is accused of stealing a Springfield XD .45 pistol and a Smith and Wesson .357-caliber revolver from the evidence room.

The affidavit says Nestor told investigators he entered the unsecured evidence room once using a step ladder and another time with a master key. He allegedly admitted to not having permission to be in the room.
