Letter-writer Karen Libby invoked the so-called “Biden Rule” as the excuse for the Republicans’ unconscionable and unconstitutional refusal to consider Barack Obama’s nomination of Merrick Garland for the Supreme Court. But Republicans unfairly distort Democrat Joe Biden’s speech on the Senate floor in 1992. He did not advocate delaying consideration of any vacancy candidate until the new president took office. Instead, he recommended delaying consideration only until after the political campaign ended with the early-November election. The Senate would take up the nomination in the final two months before the new president took office. The Republican approach with Garland also ignored the fact that the Democrats never put such a “rule” to the test — only the Republicans.
