Justin Antonin Scalia would roll over in his grave if he read Colorado .
Writing for the majority in Printz vs. U.S., the late Supreme Court justice said the 10th Amendment categorically forbids the federal government from commandeering the cooperation of state governments in enforcing federal law. According to George Mason University law professor Ilya Somin, Printz and other precedents render the federal governmentap threats of canceled funding “all but toothless.”
And since when does the Fourth Amendment have a 48-hour exception? When Immigration and Customs Enforcement asks local authorities to hold someone without a warrant, it asks local police to violate the Fourth Amendment.
