Prosecutors will not seek death penalty in trial of Berthoud teen accused of killing Ashley Doolittle

Jury selection in a 10-day murder trial against Berthoud teen Tanner Flores will begin next week as previously planned, and prosecutors will not seek the death penalty, it was announced at a court hearing Monday.

Flores, 19, accused in the June 2016 shooting death of his former girlfriend, Ashley Doolittle, faces life in prison on each of two first-degree murder allegations, plus four to 12 years on a felony kidnapping allegation. The prison term on the kidnapping charge could extend to 32 years if Flores is convicted of a crime of violence sentence enhancer in addition to kidnapping.

Eighth District Judge Greg Lammons read each count and its associated mandatory sentence before asking Flores if he understood the possible punishments upon a conviction.

“Yes, your honor,” Flores said each time.

He appeared in an orange jumpsuit at the hearing as he has remained in custody of the Larimer County Jail without bond since his arrest in June 2016.

Lammons stated 150 residents will be summoned for the potential jury pool, which will be whittled down to 14 final jurors before witnesses are called in the trial. Of the final 14 jurors, two will be alternates who would deliberate on a verdict only if required to step in for a fellow juror undergoing an emergency, or for a legal reason.
