A man accused of harassing a Hispanic family at Longmont apartment complex pool last month was formally charged with felony menacing and bias-motivated crime in Boulder County Court on Friday.

Kevin McMahon, 53, who is free on bond, made a brief appearance in the courtroom inside the Boulder County Jail on Friday afternoon, but he did not speak.

His attorney, Eric Zale, waived a formal reading of the charges. He declined to comment for this story.

Longmont police initially sought 10 counts of felony menacing, which prosectors have dropped to one count. Prosecutors also did not proceed with a misdemeanor disorderly conduct charge, according to online court records.

Police allege that on June 13, McMahon, apparently mad at a Hispanic family using the pool at the Fox Ridge Apartments, started screaming “wetback” and saying, “When Trump builds the wall, they are gonna need to know how to swim back home.”
