Colorado Secretary of State warns businesses about bogus flyers

Third-parties are charging hefty processing fees for filings

The Colorado Secretary of State issued a warning to small-business owners on Monday to disregard official looking and misleading flyers that are being mailed out to them.

In one example, offers to make a required annual periodic filing on behalf of a business to the state for the usual cost of $10, plus a $75 “processing fee.”

“We want to make sure Coloradans have the tools they need for their businesses to succeed. We have an easy-to-use and affordable business filing system. Business owners should be wary of third-party solicitations related to filing requirements,” said Secretary of State Jena Griswold in a press release.

The flyers contain the name of the business, its ID number and date of formation, which are all part of the public record. They also contain a customer ID number, which is not official. While the flyer provided had a statement saying it wasn’t from a government agency, it contained a stern warning about making a timely filing.

Compliance with the notices is not required and businesses can file any required and sign up to receive email notifications when filings are due.
