A Denver Police Department sergeant pleaded guilty and was sentenced to 18 months’ probation Thursday for pointing a gun at another man during a road-rage incident last year.
Jason Brake, 57, admitted to Class 6 felony menacing, while a Class 5 charge of the same crime was dismissed, according to court records. He must also perform 48 hours of community service and pay $1,358.50 in court fees and other penalties.
Commerce City police arrested Brake in October after another driver told officers Brake threatened him with a Glock pistol during an argument while the two were trying to pass a truck on U.S. 2.
Brake, who was off-duty but wearing Denver police apparel, told officers he never unholstered the weapon. However, the victim described a red-tinted optical sight on the gun that was not visible while it was holstered.
Brake’s victim told officers that “he thought Jason Brake was going to shoot him during the incident.”
A police department spokesperson wrote in an email that Brake has since resigned.
