DENVER—A hearing officer has overturned a four-day suspension given to a Denver city employee for allegedly asking two Latino co-workers how much it cost their “people to get across the border.”

Jack Burghardt was suspended after the Nov. 1 remark because his boss, Clerk and Recorder Stephanie O’Malley, though it had racial overtones.

A city hearing officer ruled it wasn’t clear that Burghardt meant the question to be derogatory.

Burghardt has said he meant no harm.
