CENTENNIAL, Colo.—A judge has rejected a motion to acquit an ex-Marine and Hurricane Katrina evacuee of felony murder in the death of a convenience store clerk in Aurora.
The decision Wednesday means John Doubleday will be sentenced to life in prison at a sentencing hearing Oct. 10.
A jury convicted Doubleday of second-degree murder and felony murder last month in the shooting death of 62-year-old Jutte Gallegos Burton as she worked at a 7-Eleven, but they acquitted him of aggravated robbery. The felony he was accused of committing under the felony murder conviction was robbery.
The judge ruled Wednesday that Doubleday’s convictions could stand.
