DENVER—A Denver taxi driver is accused of sexually assaulting a woman he gave a ride to after she had been drinking with friends for her 21st birthday.
The Denver District Attorney’s office says 39-year-old Patrick McCracken took advantage of the woman, but he maintains the sex was consensual. Prosecutors say the woman was intoxicated and incapable of consent.
The woman told police she passed out at her home Sept. 6 and when she awoke McCracken was on top of her.
She says McCracken left her a credit card receipt charging her for the ride and to clean up his cab because she vomited in it.
McCracken was being held on $35,000 bail.
