BOULDER — The trial date for a Louisville man charged in the death of his 11-week-old son is in limbo after lawyers were unable to finalize it on Friday.
Alex Midyette is accused of fatal child abuse in the 2006 death of his son, Jason. Doctors say he had more than 20 broken bones and a skull fracture.
The 29-year-old Midyette was to have gone on trial Monday, but a judge postponed that date two weeks ago and said the trial should be held no later than January.
Boulder district attorney’s spokeswoman Carolyn French says more time is required to find a courtroom that will be available long enough for a three- to four-week trial.
Both sides will meet again Oct. 17.
The boy’s mother, Molly Midyette, was convicted in December and is serving a 16-year sentence.
