LYONS, Colo.—A lawsuit by the U.S. Environmental Protection Agency claims a cement plant near Lyons violated federal law by not installing up-to-date pollution controls.
The lawsuit filed Tuesday in Denver federal court accuses Cemex Inc. of failing to limit nitrogen oxide pollution and emissions causing haze.
The lawsuit focuses in part on modifications at the plant about 40 miles north of Denver. The EPA says the changes resulted in violations of federal and state clean air laws.
Cemex spokeswoman Jennifer Borgen told the Longmont Times-Call Tuesday the company disputes the allegations.
The EPA says Cemex has 60 days to respond and hopes the case can be settled.
Mexico City-based Cemex is one of the world’s largest cement makers.
