DENVER—A jury has decided to reconvene Tuesday morning to resume deliberations in the case of Alex Midyette, who is charged with fatal child abuse in the death of his 11-week-old son.
Jurors got the case after nearly five weeks of testimony from medical experts and witnesses, and a day of closing arguments from prosecutors and the defense.
Deliberations started Friday.
Midyette is accused in the March 2006 death of his son, Jason. Prosecutors say Jason suffered 37 broken bones at the hands of his father.
Defense attorneys say the boy suffered from a metabolic disease.
Midyette could face up to 48 years in prison if convicted.
Molly Midyette, the boy’s mother, is serving a 16-year sentence for her December 2007 conviction for failing to get Jason medical help.
