BOULDER, Colo.—A Boulder County man convicted of criminally negligent child abuse in the death of his infant son has been sentenced to 16 years in prison, plus five years of parole.
Twenty-nine-year-old Alex Midyette had faced a sentencing range of probation to 32 years in prison.
Boulder District Judge Lael Montgomery called the neglect of Midyette’s 11-week-old son, Jason, in 2006 “pervasive and extreme” before announcing the sentence Friday.
Midyette, speaking from a prepared note, said he misses his son and apologized to him for his shortcomings.
Midyette was convicted in February. He was released on $1.5 million bond but was re-arrested on suspicion of violating his bond conditions. A hearing on the alleged violation is set for June 5.
