SAN FRANCISCO — The California high court has upheld the death sentence of the man convicted of kidnapping and killing 12-year-old Polly Klaas in 1993.

Richard Allen Davis had argued that his jailhouse confession was illegal because it was given without an attorney present.

But an unanimous California Supreme Court said Monday that police can ignore a suspect’s rights to counsel if they think someone’s life is in jeopardy. The Petaluma police still hoped Klaas was alive during Davis’ jailhouse confession.
