BOULDER, Colo.—A Longmont man has been sentenced to three years in prison and two years of parole after a judge refused to allow him to back out of a plea agreement in a stabbing case.
Judge Maria Berkenkotter sentenced 47-year-old Roy Seagraves on Wednesday, but gave him credit for 551 days already spent in jail.
Seagraves pleaded guilty in April to possession of a controlled substance. Prosecutors agreed to drop charges of first-degree assault, menacing and possession of a weapon.
In a Boulder courtroom Wednesday, Seagraves told Berkenkotter he wanted to withdraw his plea because he thought either Longmont police or the Colorado Bureau of Investigation mishandled drug evidence.
Berkenkotter said that wasn’t a valid enough reason to allow him to change his plea.
