BOULDER, Colo.—Prosecutors want to block a Longmont man accused of fatally shooting his friend from bringing up his own mental condition at trial.

Prosecutors say Joseph Abeyta may try to argue he was not sane in January, when he allegedly shot and killed his friend William Dwayne Andrews in Boulder.

Boulder County District Attorney Stan Garnett argued that a deadline has passed for Abeyta to make mental condition claims. The prosecution’s motion cites an April letter written by Abeyta to his brother in which Abeyta writes he could face a shorter sentence “if they find me poco loco.”

A hearing on the insanity motion is next month. Abeyta’s murder trial is scheduled to begin Oct. 13.
