A Colorado Springs judge Monday dismissed a trespassing charge against anti-tax activist Douglas Bruce and another man after finding that a police officer incorrectly changed the date on the ticket.

Colorado Springs Municipal Judge Spencer A. Gresham ruled that the officer erred when she changed the date on her copy of the tickets after she had issued them to Bruce and co-defendant Douglas Steinhagen.

Gresham tossed out the case, which stemmed from an Aug. 15 incident in which the two men had been collecting petition signatures in front of a Costco store.

A few minutes after the dismissal, police officers reissued the tickets with a new court date of Oct. 14.
