Q: Is there any way to get compensation for gift certificates I purchased in advance for Juicy Lucy’s, which went out of business?— Michelle Torrez, Denver

A: Juicy Lucy’s Steakhouse in Cherry Creek North closed its doors Sept. 10. The Josephine Street location has seen a number of eateries come and go.

Owners David and Cece Zumwinkle have said they just couldn’t get the concept that has been so successful for them in Glenwood Springs to work in Denver.

Known for its local elk and lamb dishes, the restaurant has been a favorite for years, but the down economy and ever-changing choices made for a challenging business climate.

Gift certificates to restaurants are a very popular item, mostly because they’re simple to purchase and can make an otherwise expensive night out a bit more affordable.

Where problems can surface is, as in your case, a business shuts its doors before a gift certificate can be redeemed. Colorado consumer protection laws are clear: The consumer has purchased an item and the retailer is bound to honor the agreement, but keep an eye to the fine print.

Where things get dicey is if the business that’s closed has done so as a result of bankruptcy. In that case, the consumer has little recourse.

However, Juicy Lucy’s is one business that is open and operating in another location. Not unlike the closing of a large retailer in one neighborhood, another store location would honor the gift card.

Not willing to schlep to Glenwood Springs, despite the beauty of the drive?

Give the Zumwinkles a call — 970-945-4619. Depending on the type of gift certificate — those purchased via other outlets or from the restaurant — you might have to go to the issuer for your money. But don’t count on a refund from Juicy Lucy’s.
