FRUITA, Colo.—Voters in Fruita may be voting in April on whether to tax the sale of medical marijuana.

The Fruita City Council this week approved the creation of the tax and next month officials are expected to add the question to the ballot of the April 6 municipal election. If approved, medical marijuana and medical marijuana paraphernalia would be subject to a 5 percent sale tax.

The city says sales tax revenue from medical marijuana could be used to help pay for law enforcement and other departments that will need to ensure that dispensaries are complying with state and local laws.

Colorado Attorney General John Suthers said in a November opinion that medical marijuana is subject to state and local taxes.
