ASPEN, Colo.—An Aspen judge says he might reconsider allowing a medical marijuana user to take the drug while on probation if a doctor can prove the man needs it.
District Judge James Boyd Monday sentenced Keith Timothy Pfeiffer to two years probation on a felony charge of attempted distribution of cocaine. A standard condition of probation includes not using alcohol or illegal drugs.
Boyd says marijuana remains illegal under federal law, despite Pfeiffer’s state registry card allowing him to use pot for medicinal purposes. Boyd called the issue troubling.
The 57-year-old Pfeiffer says he needs marijuana to cope with pain from hepatitis and cirrhosis of the liver, as well as two hip replacements.
