District Judge William Hood awarded $4.8 million to an Arapahoe County woman in a case involving breach of a title insurance contract.

In September 2004, Mary Scott bought about 20 acres of land in Cherry Hills Village that she planned to subdivide.

Hood found that a title defect prevented Scott from being able to subdivide the land, which greatly reduced the value of the property.

Because the title defect was insured under the title insurance policy, the judge ruled that Chicago Title, the underwriter for the policy, was responsible for paying Scott for the reduction in value.


This article has been corrected in this online archive. According to the court filing, the title-insurance policy was issued by an agent, Land Title Guarantee, and Chicago Title served as the underwriter for the policy.
